No, Dear, There is a First Amendment RIght

Court Hands Down A MASSIVE Victory for Freedom on the Fourth of July

On Independence Day, July 4, 2023, the forces of freedom won a major victory, and the Biden regime suffered a historic defeat. May there be many more days like this.

The Biden regime is authoritarian to the core. Like every hard-Left authority in the history of the world, it is intolerant of dissent and determined to stamp out all opposition, not by defeating it at the ballot box, and certainly not by besting it in the court of public opinion, but by forcibly silencing it. But on Tuesday, Judge Terry Doughty, Chief U.S. district judge of the United States District Court for the Western District of Louisiana, put a massive roadblock in the way of Biden’s handlers’ ongoing efforts to ensure that only their own perspective can be heard in the American public square.

In a landmark ruling in Missouri v. Biden, Doughty struck back hard against what he called “the most massive attack against free speech in United States’ history.” Doughty even began his decision by quoting the most famous adage regarding the importance of the freedom of speech: “I may disapprove of what you say, but I would defend to the death your right to say it,” a statement that is often attributed to Voltaire but which Doughty credits to the early twentieth-century English writer Evelyn Beatrice Hall (whom he mistakenly calls Hill, but that doesn’t detract from the power of his ruling).

Doughty declares that “in their attempts to suppress alleged disinformation, the Federal Government, and particularly the Defendants named here, are alleged to have blatantly ignored the First Amendment’s right to free speech.” He noted that “Plaintiffs allege that Defendants, through public pressure campaigns, private meetings, and other forms of direct communication, regarding what Defendants described as ‘disinformation,’ ‘misinformation,’ and ‘malinformation,’ have colluded with and/or coerced social-media platforms to suppress disfavored speakers, viewpoints, and content on social-media platforms.”

Specifically, Doughty noted:

Plaintiffs allege that Defendants suppressed conservative-leaning free speech, such as: (1) suppressing the Hunter Biden laptop story prior to the 2020 Presidential election; (2) suppressing speech about the lab-leak theory of COVID-19’s origin; (3) suppressing speech about the efficiency of masks and COVID-19 lockdowns; (4) suppressing speech about the efficiency of COVID-19 vaccines; (5) suppressing speech about election integrity in the 2020 presidential election; (6) suppressing speech about the security of voting by mail; (7) suppressing parody content about Defendants; (8) suppressing negative posts about the economy; and (9) suppressing negative posts about President Biden.

All that is abundantly true, and there are plenty of other examples of the regime’s hatred of dissent as well. Regime spokesbeings, however, will tell you that all they really want to do is protect poor, ignorant, distracted, gullible Americans from “disinformation.” It became clear when the Biden regime established its ill-fated and quickly disbanded Disinformation Governance Board that it had decided that labeling reports that departed from the officially approved line as “disinformation” was a likely winning strategy, both to circumvent the First Amendment and to hoodwink Americans into thinking that the crushing of dissent was a valuable service.

Doughty, however, pointed out that it was not the government’s role at all to silence opposition voices; rather, he reminds us that “the principal function of free speech under the United States’ system of government is to invite dispute; it may indeed best serve its high purpose when it induces a condition of unrest, creates dissatisfaction with conditions as they are, or even stirs people to anger.” This is as far from the Biden regime’s conception of the function of free speech as Los Angeles is from Pluto’s moons, and that’s precisely why this ruling is so urgently needed, and so welcome.

Doughty wrote: “During the COVID-19 pandemic, a period perhaps best characterized by widespread doubt and uncertainty, the United States Government seems to have assumed a role similar to an Orwellian ‘Ministry of Truth.’ The Plaintiffs have presented substantial evidence in support of their claims that they were the victims of a far-reaching and widespread censorship campaign.” He added: “It is quite telling that each example or category of suppressed speech was conservative in nature. This targeted suppression of conservative ideas is a perfect example of viewpoint discrimination of political speech. American citizens have the right to engage in free debate about the significant issues affecting the country.” Yes, they do, and in Missouri v. Biden, Doughty has done a great deal to protect that right. This decision prohibits the government from working with social media giants to censor American citizens.

Will the regime fight back? Almost certainly. Will it craft a deceptive, Orwellian, disingenuous, paternalistic argument for censorship based on its claimed responsibility to protect Americans from “disinformation”? That seems likely as well. But the more it fights in cases of this kind, the more its authoritarian nature becomes clear. Will Americans quietly accept the yoke of censorship? We have a history of resisting tyranny. It is no accident, comrade, as Biden’s Marxist friends would say, that Doughty’s ruling came on Independence Day.

Some Light in the Darkness

STAFF NEWS & ANALYSIS
Some positive moments amid all the turmoil
By Simon Black – June 05, 2020

via Sovereign Man

Look, things aren’t feeling so bright and cheery in the US right now. And the sad truth is that there are some tough times ahead.

We usually bring you stories on Friday that are absurd or even infuriating.

I’m sure you’ve seen enough of that this week.

So we thought we’d share a few moments of character and integrity shown at protests across the US, which shined through all the tragedy.

There are bad apples on all sides– some bad apple protestors who loot and burn and destroy. And some bad apple cops who engage in terrible acts of violence.

But there are plenty of good apples on both sides too.

Protesters tackle man breaking up sidewalk for projectiles

Peaceful protesters sprang into action when they saw a man destroying a sidewalk.

The man was dressed in all black, like Antifa, and was apparently destroying the sidewalk to create projectiles to hurl at police and businesses.

But rather than let things escalate, peaceful protesters tackled the man, took his hammer, and handed him over to a group of police who were nearby.

In fact, the police were right standing there, with the man in clear view. And yet they did nothing to stop him.

Cops even almost arrested one of the peaceful protesters who handed the man over. But they let him go after someone explained the situation.

Protesters hold line in front of business to stop looters

Undoubtedly there has been way too much violence, looting, and property destruction. Nothing takes away the moral high ground from a movement like seeing a bunch of guys walk out of an electronics store with big-screen TVs in hand.

And in the early days of these protests, the rage was palpable. Cars were torched, businesses were destroyed, and so much property was stolen.

But people are starting to take a stand against that type of chaos.

In Brooklyn, a group of protesters intervened a few days ago when looters and vandals approached a Target store.

The protestors formed a line in front of the store to stop the looters from smashing windows (and stealing store inventory).

FBI asks for evidence of inciting violence. People send videos of cops instead.

Being an activist in the US, you have to have a sense of humor.

So when the FBI asked the public to send them video evidence of protestors inciting violence, they were inundated with videos of police officers being violent.

“The FBI is seeking information and digital media depicting individuals inciting violence during First Amendment protected peaceful demonstrations,” the FBI wrote on its Twitter account.

The FBI’s website said, “If you witness or have witnessed unlawful violent actions, we urge you to submit any information, photos, or videos that could be relevant to the case.”

People responded on Twitter with video of:

  • New York City Police ramming protesters with their vehicles,
  • Police appearing to aim a smoke grenade launcher at a little boy,
  • Police attacking, beating and throwing punches at clearly marked media with cameras,
  • Police spraying peaceful protesters with mace unprovoked,
  • Police/ National Guard firing pepper bullets at a woman filming from her front porch,
  • Police throwing an old man with a cane to the ground.

Michigan Sheriff leads protestors in peaceful march

This is starting to be a bigger trend: police are putting down their tear gas and riot shields, and joining the protestors to peacefully demonstrate for reform.

In one great example of humanity and leadership, Genesse County, Michigan’s sheriff Chris Swanson met a crowd of protestors, and actually took charge to compassionately lead their march through the city.

This is pretty extraordinary. Protests are typically leaderless, and mobs can take on a life of their own.

But Swanson took charge, telling the crowd “I want to make this a parade.” The cops put their weapons down, took their helmets off, and marched together with the protestors… which ensured that (a) the protestors’ voices were still loudly heard, (b) they could march without any threat of violence, and (c) everything remained safe and orderly.

 by Mac Slavo of SHTFplan

When a mother in Idaho was arrested for playing a park with her children, the mainstream media took glee in the tyranny and made sure to try to smear her as an “anti-vaxxer.” But the people of Idaho came together and surrounded the cop’s house in a show of support for liberty.

The mainstream media, government, and elitists are panicking at the fact they are unable to control the public any loner.  This can be seen in the attempts to smear anyone who doesn’t live in fear or researchers on their own to discover the “official narrative” is bullshit.  Here’s what the Huffington Post said about Ammon Bundy, who organized the protest at the tyrannical cop’s home:

It’s the militia leader’s latest escalation in his attempt to use the COVID-19 pandemic to spread his extremist, anti-government views. –Huffington Post

The Huffington Post got the memo that many people are quickly turning against the government and the media because of this scamdemic. Their attempts to keep the public scared of people who are standing up to the government are laughable at this point. Few are buying it anymore, and we are witnessing the end of the mainstream media’s fear-mongering and the tyrannical government control over our lives.

“There was a woman at a park with her children and she was arrested!” Bundy yelled at the four or five cops standing in the driveway, watching guard over their fellow officer’s home. “Completely inappropriate.”  Bundy was referencing the arrest, earlier that day, of Sara Walton Brady, a prominent Idaho “anti-vaxxer” (oh no! Not a person who thinks they own the rights to their own body and what goes in it!) who staged a protest at a Meridian playground shuttered due to town measures to slow the spread of COVID-19.

Notice how now, those who stand up to tyranny, forced vaccinations, and simply want their God-given rights to freedom respected are being demonized as “anti-vaxxers?” Well, if that’s what they want to call those of us who will refuse Bill Gates’ forced vaccines, so be it. The media is losing control of the narrative they have spun for the government. It’s all crumbling beneath them, and that’s the reason they are doubling-down.  They want the masses brainwashed and incapable of thinking for themselves.

Those who do their own research and think for themselves are now the targets of mainstream media and the governments they support. But more and more people are rejecting the notion of a ruling class and their manipulative brainwashing puppets in the media.

“The people will not allow you guys to do this for very long!” Bundy yells at the cops in the video. “You will not go into the park and arrest people! You will not go into parks and arrest mothers, and you will not go anywhere and arrest us for exercising what our rights are.”

Bundy is correct, it’s the mainstream media and the government that are on the wrong side of history.  The people are not going to tolerate tyranny for much longer. Even after this scamdemic is over, civil disobedience and standing up to the government isn’t going to stop.  The people have finally figured out who the enemy is and the more the media tries to push to blame back on to those promoting liberty, the more people will wake up to what’s been done to them by tyrants.

Freedom is no longer negotiable and people all over the globe are figuring out that they have basic human rights long denied by rulers, elitists, and those wanting to enslave them.  But the ruling class’s agenda is failing right now, before our eyes.

The 1st Amendment States…

(NOTE:  Apparently exercising our Constitutional RIghts is “Non-Essential”)

“Protesting is Non-Essential” – Police Make Tyrannical Claim as Citizens Demand Economy Reopen

By Matt Agorist

“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.” — Amendment 1, United States Constitution

Raleigh, NC — The state of North Carolina is one of the least affected states in the country with regard to the current COVID-19 outbreak. With just over 5,000 confirmed cases and only 108 deaths related to the virus, many citizens are growing wary of the state’s lockdown order and are demanding things go back to normal.

On Tuesday, more than 100 protesters took the the city streets of Raleigh, North Carolina to voice their desire to reopen the the state’s economy. They were quickly met with police action but the well-organized protesters stood their ground through multiple threats.

According to the News and Observer, the protest was organized by ReopenNC, a private Facebook group organized last week that wants people to make their own stay-at-home decisions to avoid exposure to COVID-19 as the worldwide pandemic continues. The group surpassed 28,000 members on Tuesday afternoon.

When the protest began, the Raleigh police department put out a tweet that is sure to go down in history books as they declared the Constitutional right to peaceably assemble, otherwise known as the First Amendment — “non-essential.”

During the protest, the police department filmed their officers ordering the crowd to disperse as their commands fell on deaf ears.

“You are in violation of the executive order,” said a police captain. “You are posing a risk to public health. If you do not disperse, you will be taken and processed at Wake County jail.”

Every 15 minutes during the protest, roughly 50 cars honked their horns in unison.

“You should be ashamed of yourself,” said one protester.

“Are you goons of Cooper or servants of the people?” said another, in reference to governor Roy Cooper’s executive order.

“We are in violation of Comrade Cooper’s order,” said Leonard Harrison of Mebane. “If I get locked up today, I’m OK with that. As North Carolinians, we need to get back to work.”

After multiple threats of arrest and police force, most of the protesters finally began to disperse — only under duress.

One person did get locked up, however, and that was Monica Faith Ussery, 51, of Holly Springs. She was charged with violating the executive order to stay at home.

“I have a right to peacefully assemble,” she said as officers led her away, her hands bound with a zip tie. “God bless America.”

After the protest on Tuesday, the Raleigh police posted video of it online.

They were met with massive backlash. Nevertheless, Raleigh police and the governor’s office doubled down on their decision.

“Some people want to completely obliterate these restrictions,” Governor Cooper said . “It would be a catastrophe. The numbers are very clear that the interventions that we’ve entered into — social gatherings, limitations on bars and restaurants, the stay at home order — those kinds of things are working.”

As the Observer reports, in a statement Tuesday night, the Raleigh Police Department stood by its tweet as well as officers’ obligation to enforce the stay-at-home order during “these unprecedented times and unusual circumstances.” They said there’s no exemption spelled out in state and Wake County stay-at-home orders for protesting like there is for other “essential” activities.”

“But more important is the health and wellness of all who live in our community, including the officers who must engage in circumstances such as these,” the statement said. “We simply want everyone to be safe during this very serious public health crisis.”

The protest was not in vain. According to reports, it sparked a conversation among officials on how to proceed with possible future protests as well as reopening the economy.

In an email to The News & Observer, Raleigh police said they are “having ongoing conversations with Wake County officials and the Wake County District Attorney’s Office on the scope and enforcement” of both the local stay-at-home order and the statewide order.

The Raleigh Police Department added in its statement:

The Wake County District Attorney is the individual who decides charging language for failure to adhere to the Governor’s Orders and the Wake County Proclamation, when charging is appropriate, and what charges individuals may face for violating either one of these orders.

As more people grow tired of watching their life savings diminish and their local economies turn to dust, rest assured that more protests like this one are inevitable. Instead of brute force and fear, it may be time to rethink the solution to COVID-19.

No one here is discounting the severity of the coronavirus. However, multiple experts have stated that social distancing and lockdowns may be a temporary fix and may only be serving to suppress the virus.

“I think they did an amazing job of knocking the virus down,” said Michael T. Osterholm, director of the Center for Infectious Disease Research and Policy at the University of Minnesota, in regard to China’s lockdown. “But I don’t know if it’s sustainable. What have the Chinese really accomplished? Have they really contained the virus? Or have they just suppressed it?”

Doom is a mathematical certainty of this prolonged economic scenario in which we currently find ourselves. There is fight and there is flight when it comes to all situations, especially COVID-19. Running from it in flight mode is sending us back to food lines and doing possible irreversible damage to America’s economy. I don’t know what the fight mode looks like yet, but it’s high time we start discussing it.

Watching How You Think

THE NORMALS VS. CONSPIRACY THEORISTS

Jon Rappoport, Guest
Waking Times

In the wake of the recent mass shootings; and after the FBI concluded that conspiracy theories could fuel terror attacks; and after the major media and politicians hoisted the notion that free speech should be further eroded, in order to protect the citizenry; the obvious choice for persons who want to avoid blame for violence is: REMAIN NORMAL.

Eyes straight ahead. Don’t think. Obey official orders. Maintain a pleasant outward appearance. Don’t question authority. If you accidentally encounter information that points to crimes committed by those in power, don’t bother trying to figure out where on the political spectrum they reside. Instead, move along, forget what you experienced, keep your mouth shut. Play dumb. Better yet, become dumb.
